Maximum Awards
|
As of
December 22, 2001, the maximum coverage for AST and UST remedial
efforts will be $190,000 with a flat $10,000 deductible per occurrence.
Note: Annual aggregate per owner /
operator is $190,000.
For an owner or operator of an AST or UST system who
has an emergency action approved by Commerce or an investigation
started prior to December 22, 2001 [see Comm 47.335
(4) for 'start of investigation'], the current deductible, coverage
amounts, and aggregates will apply.
Tanks identified as Public / Technical School District
tanks, farm tanks or home heating oil tanks will maintain current
coverage and deductible amounts.

AST Eligibility
|
AST systems upgraded to meet current standards or
installed after April 30, 1991 are not eligible for
reimbursement under the PECFA Program if contamination is
confirmed after December 22, 2001. |

$50,000 Milestone

|
The recently enacted $50,000.00 claim submittal milestone
is for ALL claimants who have incurred at least
$50,000 in eligible, unreimbursed costs and who have not submitted a
claim in the previous 12 months. This DOES INCLUDE
owners or operators who meet the test of self-insurance under COMM
10.82.
Claim submittals at progress payment
milestones are not mandatory, but are encouraged to help reduce owner
costs as well as program costs. (See
Update 16
for claim submittal requirements)

GIS
|
The GIS Registry provides a database that shows all
closed groundwater contaminated properties. This provides information
to future property owners and allows for proper potable well
construction for properties with residual groundwater contamination.
A $250 fee (NR 749) must be paid to DNR for
each site when requesting case closure with groundwater contamination
remaining above ch. NR 140 enforcement standards, regardless of
which agency approves closure. Any fees received by the Department
of Commerce will be returned to the sender. A case closure
submittal will be considered complete only if the fee has been paid
. Please note that any fee (NR 749) imposed by the DNR
is not
reimbursable by PECFA per Wisc. Stat.
101.143(4)(c) 10.

Investigations
|
Investigations must be completed by the first day of
the 61st month after notification of contamination or
interest costs incurred after that date are ineligible.
If notification was before August 31, 2001, the
investigation must be completed by the first day of the 61st
month after notification of contamination or the first day of the 25th
month after August 31, 2001, whichever is later; interest costs
incurred after the later of those dates are ineligible.

Incomplete claims
|
Submitted claims
must
be complete claims. The department provides a
checklist (see form) in each
claim packet and requires all information requested to be submitted
before the claim is considered complete. Incomplete claims will be
returned to the responsible party for completion and resubmission.
Q: What happens if a final,
incomplete claim is mailed to the department within the 120 days after
a "no further action" letter received prior to
August 31, 2001 and isn't resubmitted as a completed final
claim until after the 120 days from receipt of the letter?
A: The date of submittal of any claim
is the date of receipt of the
completed
claim. For the situation as cited above, interest
after January 2, 2002 would be ineligible for PECFA
reimbursement.
If the "no further action" letter is received after
August 31, 2001 and an incomplete final claim is returned to
the responsible party and resubmitted as a completed final claim more
than 120 days after the letter was received; interest after 60
days
from the date of the "no further action" letter is ineligible
for PECFA reimbursement.

| Consultant Registration |
The department is in the process of being able to mail
all correspondence from the department to each consultant's office by
using the consultant's registration number. Consultants may wish to
register each satellite office for direct receipt of correspondence. If
satellite offices are not registered, only the registered primary
office will receive correspondence from the department.
