- A public hearing
will be held October 21, 2009, on an emergency rule that effects the
recently adopted Comm 20 to 25 changes relating to the approved version
of REScheck software used to show compliance with the Uniform Dwelling
Code thermal envelope requirements.
- Permanent rules
implementing Building Contractor Registration are effective October 1,
2009. The emergency rules are in effect until then. Here is a
timeline of four dates that are important to understanding the BCR
development.
- Agenda is online for the Plumbing Advisory Code Council's October 8, 2009, meeting.
- A proposed code package
was sent September 24, 2009 to the legislature for commitee review. It
involves Comm 82, Plumbing Code; Comm 5, Licenses, Certifications, and
Registrations Code; and Comm 2, Fee Code. The code changes would
increase the permit to operate fees for boilers, pressure vessels,
anhydrous ammonia systems, mechanical refrigeration systems,
conveyances and passenger ropeways to reflect the cost of providing
these programs; promulgates rules for the testing and registration of
cross-connection control devices; and clarifies plan review and
approval procedures for certain water treatment systems where the
source of water is a well or surface water.

legislation approved May 28: "Construction
Contractors. Require effective January 1, 2010, the
following: (a) 1% withholding of payments to independent contractors
and single-member limited liability companies (LLCs) providing
construction services when a 1099 tax form is filed; (b)
establish a fine of $25,000 under state laws governing unemployment
insurance, worker's compensation, equal rights, state income, sales,
excise, and inheritance, and public safety for willful
misclassification of workers; (c) require construction
contractors to register with the Department of Commerce and provide
Commerce with authority to levy an administrative forfeiture for
failure to register; (d) exempt homeowners, tenants, and
state and local government units from these provisions; and (e) require
Commerce to promulgate administrative rules to administer regulation
under (c)."
(The Building Contractor
Registration goes into effect July 1, 2009, under a currently valid
emergency rule.)

Proposed draft permanent rules changes to Comm 66 and Comm 21 were
adopted on April 13, 2009, to replace the emergency rules issued in
September 2009 related to installation of carbon monoxide alarms in
tourist sleeping rooms under the UDC and to alarms in commercial

effect, with the permanent rules effective June 1, 2009.

Commerce Secretary Dick Leinenkugel requested a 60-day extension of the
Comm 2, Fee Code, emergency rule reducing fees to pre-December 1, 2008,
levels for public swimming pool plan review of post-construction
modification. The extension was granted by the Joint Committee on

- A change has been made in the
fees to be charged for lighting plans submitted
for review separate from the general building plans, but with another
related set of review plans. The change will reduce the fee

parties. The Nov. 17 germane modification delays until January 1, 2010,
the NEC requirements for arc-fault circuit-interrupter protection and
for tamper-resistant receptacles in dwelling units. It also changes the
effective date of the rules to the first day of the month following
publication in the Wisconsin Administrative Register. This germane
modification supersedes the modification sent November 5, 2008, to the

What's
Happening at S&B - March 18, 2008
-
The Wisconsin statutory
mandate for superinsulation of one and two-family dwellings heated by
electricity was rescinded by recently-signed 2007 Act 67, which will be
effective at the end of March. The act says: "The department may not
promulgate or enforce a rule that requires that any one-family or
two-family dwelling that uses electricity for space heating be
superinsulated." S&B will be developing rules in the future to
remove the current regulations, which are not now enforceable. See PDF

Village of Hollandale, Iowa County.

of fixed non-mechanical and coin operated rides that were registered in

Dwelling Code Council are Brian Juarez, Fort Atkinson, Dennis
Bauer, McFarland, and Robert Premo, Hartland.

The March 1, 2008, changes to Comm 14, Fire Prevention Code, allow
municipalities to adopt without a special order from S&B the
requirements of the 2006 International Fire Code and any additional
requirements equivalent to the new Comm 14. See PDF
