Building Contractor Registration Timeline
March 1, 2009 - Effective date of emergency rule which established the Building Contractor Registration rules requiring registration by July 1, 2009. - BCR rules help identify whether construction work is being done by an employee or a business, in order to counter misidentification of employees (misidentifying someone as a contractor in order to not fulfill employment oblications). The registration supports contractor business participation in unemployment and workers compensation insurance programs, and proper payment of taxes. The registration also helps S&B provide information to contractors about codes and other topics of the construction industry in Wisconsin. July 1, 2009 - Effective date of Building Contractor Registration emergency rules: Construction businesses working under these Wisconsin codes - commercial building, uniform dwelling, electrical, plumbing, and swimming pool - need a Building Contractor Registration issued by the state Dept. of Commerce, Safety and Buildings Division, unless the company already holds another contractor credential issued by the division or is working on real estate or property the business owns or leases. - The BCR is for businesses, not employee of construction contractors. The business may be one person. - The 4-year registration fee is $100 when accomplished online, $115 when using paper form. - Contractors need to include BCR number on construction bids and contracts, are required to not contract with another business (construction subcontractor) that does not have appropriate construction credentials, and may not start work without proper permits and plan review. - Building Contractor Registration does not affect someone's ability to obtain one- and two-family dwelling building permits. The two dwelling contactor certifications are still needed to obtain those permits. October 1, 2009 - Effective date of Building Contractor Registration permanent rules: The permanent rules continue the features of the emergency rules and extend to other S&B construction contractor categories the requirement for not contracting with subcontractors which do not have appropriate credentials. Those other construction contractor categories are listed as "a" through "i" here. January 1, 2010 - Effective date of legislation included in the 2009 state budget (Section 2155m.) that directs Commerce to create rules for forfeitures that could be assessed against any business not having the BCR when it is required. An example of a forfeiture system is in Comm 5.12 (Licenses, Certifications, and Registrations Code) related to violations of plumbing credential rules. - The type of work which will be defined as requiring contractor registration could be expanded to reflect the budget legislation directing Commerce to create the rules. - Information on the process of creating the building contractor forfeiture rules will be sent to people who are subscribers to the S&B building / dwelling contractor email group. Sign up here. Comm 5.30 Building contractor. (1) GENERAL. (a) Except as provided in par. (b), no person or entity may engage in a construction business or offer to engage in a construction business that affects public buildings, places of employment, one- and 2- family dwellings, public swimming pools and water attractions, unless the person or entity holds a registration issued by the department as a registered building contractor. (b) Paragraph (a) does not apply to any of the following: 1. A person or entity that holds any of the following credentials issued by the department: a. A dwelling contractor certification. b. A dwelling contractor – restricted certification. c. A manufactured home manufacturer license. d. A manufactured home dealer license. e. A manufactured home installer license. f. An electrical contractor certification. g. An electrical contractor – restricted certification. h. An HVAC contractor registration. i. An elevator contractor license. 2. A person or entity that works only on real estate or property they own or lease.
